Terms of Service

1. Scope and provider

These Terms govern use of the website and application AiCutting at https://dronecutai.com. The provider is Tim Adrian Ribbat, trading as AiCutting, c/o Online Impressum #8217, Europaring 90, 53757 Sankt Augustin, Germany. AiCutting is an online service that automatically selects, edits, colour-adjusts, titles and synchronises uploaded drone footage with music. The editing is performed by an artificial intelligence system; delivered videos are marked as AI-edited in their file metadata (Article 50 of Regulation (EU) 2024/1689).

2. Contract language

The contract language is English. This English version is the legally authoritative version of these Terms.

3. User account

An account is required for protected functions. Users must provide accurate information, keep their credentials confidential and protect them from third-party access. Registration itself is free and does not require a purchase.

4. Service and quote-first workflow

After footage and a track have been uploaded, AiCutting creates a quote showing the credit cost and estimated processing time. The quote is provided before rendering. No render starts and no render credits are charged until the user expressly confirms the quote. The confirmed job is then processed automatically and, if successful, supplied as a full-quality download.

5. Credits, prices and tax treatment

Credits can be purchased in the application and used to confirm renders. The current offer is shown before purchase and before a render is confirmed. Unless another rate is displayed, the price of a cut is based on the uploaded source material: each started block of ten uploaded minutes uses one credit at 1080p and three credits at 4K, plus one additional credit where the optional social-cuts package (teaser and short) is ordered. The quoted price is final when the quote is confirmed; the length of the finished video does not change it. Orders confirmed before 25 July 2026 remain under the previous per-output-minute rate, including its delivered-length settlement. Credits do not expire while the account exists.

All displayed euro amounts are final prices. No VAT is charged under section 19 UStG (German Small Business Regulation).

6. Payment and contract formation

Credit-pack payments are processed by Stripe. A paid credit-pack contract is concluded when the user selects the pack, is shown the total price, submits the payment order in Stripe Checkout and payment is confirmed. A render order is concluded when the user confirms its quote, accepts immediate performance and the stated credits are deducted.

7. Rights in uploaded material

The user retains all rights in uploaded material. For the duration and purpose of performing the contract, the user grants AiCutting a non-exclusive, worldwide right to store, technically process, analyse, select, edit, render and make the uploaded material and resulting video available to that user. AiCutting claims no ownership of the uploaded material or result.

8. User responsibilities

The user warrants that all necessary rights exist for the uploaded footage, audio, music, logos, people, properties and other protected content. The user is responsible for ensuring that drone recordings were lawfully made, including compliance with aviation rules, privacy, personality rights, property rights and flight restrictions.

9. Prohibited content

Users may not upload unlawful or infringing content, covert-surveillance material, intimate or private situations without authorisation, content glorifying violence, or other material that violates applicable law. AiCutting may reject, block or delete such material.

10. Automated and AI-generated results

Editing decisions are generated automatically. A technically conforming result may not match every subjective creative preference. This does not limit statutory remedies for defective digital products.

11. Availability

AiCutting aims to provide a reliable service but does not guarantee uninterrupted availability. Maintenance, technical faults, capacity limits, third-party failures and force majeure may temporarily restrict the service.

12. Cancellation, failures and refunds

An unconfirmed quote can be discarded without charge. If a paid render fails or is cancelled through the available cancellation flow, the credits charged for that render are refunded automatically. Statutory refund and remedy rights remain unaffected.

13. Account and data deletion

Users can delete their account in the application or request deletion by email. Account data, jobs, uploads and renders are deleted in accordance with the Privacy Policy, except where a legal obligation or the establishment, exercise or defence of legal claims requires limited continued retention.

14. Right of withdrawal

Consumers have a statutory right of withdrawal. Details, including the circumstances in which that right expires early for paid digital content supplied immediately, are set out in the Right of Withdrawal.

15. Statutory remedies

The statutory remedies for digital products apply. In the event of a defect, consumers may exercise the remedies provided by applicable law. Nothing in these Terms restricts mandatory consumer rights.

16. Liability

AiCutting is liable without limitation for intent, gross negligence and injury to life, body or health. In cases of ordinary negligence, liability exists only for breach of an essential contractual duty and is limited to the foreseeable damage typical for the contract. Mandatory statutory liability, including liability under the Product Liability Act, remains unaffected.

17. Indemnification

If a user culpably violates third-party rights or applicable law through uploaded material, the user shall indemnify AiCutting against justified third-party claims, including reasonable legal defence costs. This does not apply where the user is not responsible for the violation.

18. Changes to these Terms

AiCutting may amend these Terms where technical, legal or economic developments make a change necessary and the change is reasonable for the user. Users will be informed of material changes in good time. Mandatory rights remain unaffected.

19. Governing law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protections of the country in which they habitually reside. AiCutting is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board. If any provision is ineffective, the remaining provisions remain effective.
