Terms of Service
1. Scope, provider
These terms govern the use of the online service AiCutting, operated by AiCutting ("we"). The service automatically turns uploaded drone video footage into a finished, music-synced video edit.
2. Conclusion of contract, account
By registering and accepting these terms and the privacy policy, a usage contract is concluded. You are responsible for keeping your login credentials confidential.
3. Service
We provide the automatic processing as "software as a service". A free, watermarked preview edit is part of the service; unlocking the full-quality file is done against credits.
4. Prices, credits, payment
Billing is metered in render credits by length and quality of the result (e.g. 1080p = 1 credit/minute, 4K = 3 credits/minute). Prices include statutory VAT where applicable. Credits are purchased in advance and consumed on unlocking.
5. Rights in your material and the result
- You remain the owner of all rights in your uploaded footage.
- You grant us a simple licence, limited to providing the service, to store and process the material and create the result from it. This licence ends on deletion.
- You may use the finished result without restriction; we claim no rights in it.
6. Your warranties (in particular music and recording rights)
You warrant that you hold all necessary rights in the uploaded footage and in any music you upload yourself, or that it is royalty-free / cleared, and that the recordings were lawfully made (including EU drone regulations). You indemnify us against third-party claims arising from a culpable breach of these warranties.
7. Acceptable use
Unlawful, infringing or covert-surveillance content is prohibited. We may refuse to process such content and operate a notice-and-takedown procedure.
8. Right of withdrawal
Consumers have a right of withdrawal; details and the early expiry for immediately supplied digital content are set out in the Right of Withdrawal.
9. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For simple negligence we are liable only for breach of material contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract. Otherwise liability is excluded. For data loss we are liable only up to the typical restoration effort assuming proper data backup.
10. Availability, changes
We aim for high availability but do not owe uninterrupted access. We may further develop the service where this is reasonable for you.
11. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer-protection rules of your country of residence remain unaffected. Should individual provisions be invalid, the remainder of the contract stays effective.
